2012年8月9日,葡萄牙通过了新的移民法,即29/2012号法案(Act n.29/2012 of August)。该法案是对23/2007号法案(Act n.23/2007 of July 4)的修订。根据这一新法案,葡萄牙外交部和内政部于2012年9月3日颁布了11820-A/2012号政令(Order n.11820-A/2012),并于2012年10月8日开始生效。
自此开始了轰动全欧并引起投资者高度关注的葡萄牙置业移民。这一新的投资移民法案,被称为葡萄牙的“黄金居留计划”(Golden Residence Permit Programme)。
2013年1月28日,葡萄牙政府又颁布了新的修正案,即1661-A/2013号政令,将居住时间要求及创造就业人数大大降低。

Value of Property to be purchased – minimum Euros 500,000 which must be totally free of mortgages or liens. Originally this meant that Bank loans or loans from the developer are not accepted. The property has to be paid in full at the time of the TRP application.
购买房产的价格 – 至少50万欧元,无任何贷款或抵押。过去的这一条款意味着不接受任何银行贷款或开发商贷款。房产的全款必须在申请临时居留许可时支付。
By a Ministerial declaration dated 30th January, 2013 the policy has been changed and the following two principles apply :

In the first place if the applicant has purchased a property of above Euros 500,000 and has effectively paid the sum of Euros 500,000 then he can apply for Bank financing for the balance.
第一点,如果申请人购买超过50万欧元的房产,其中50万欧元实际已支付,则超过50万欧元的部分可申请银行贷款。
In the second place if the applicant signs a preliminary or promissory agreement to purchase a property and has deposited the sum of Euros 500,000 into an escrow account, then the Final Deed of Sale and Trasfer can be signed after the issue of the TRP but not later than the first year from when the TRP is issued. In this way, the applicant is guaranteed to have acquired a TRP prior to the Final Deed of Sale and Transfer.
第二点,如果申请人已在第三方监管账户存款50万欧元,并签署初步购房协议,则最终购房协议、申请房产过户可在TRP批准之后一年之内签署。也就是说,申请者可在签署最终购房协议之前获得TRP。
The applicant must show that he has a minimum annual income of Euros 6000. There is no requirement to prove assets nor is a business background a requirement.
申请人必须可证明拥有至少6000欧元的年收入。无其它资产证明或经商背景的要求。
He must be over 18 years of age
申请人必须年满18周岁
He must have a clean criminal conduct certificate.
申请人必须拥有无犯罪记录证明
The property acquisition process would normally involve the signing of a provisional agreement wherein a nominal deposit would be expected to be deposited. This deposit is forfeitable. Within a reasonable period a further percentage would be expected to be deposited. There is no hard and fast rule and this would be established by agreement between the parties. Then within three months the full purchase price is required to be deposited and the Final Deed of Sale and Transfer signed. All these do not require the presence of the Purchaser and can be effected through fully legalised Power of Attorney. However now there is the option of signing a preliminary agreement, then apply for TRP as explained above
房产购买的过程通常涉及签署一份临时协议,此处涉及一笔名义存款。开发商在买方放弃购买后有权没收该存款。在一段合理的时间内买方需再次存款。开发商和买方之间不必严格地签署协议。房产的全款在三个月内付清后,签署购房协议,进行房产过户。以上工作无需买方在场,可通过签署委任书由律师全权代理。然而,根据上述最新公告,可先签署初步购房协议,然后申请TRP。
The presence of the applicant and family members which are covered by the TRP is required on the issue of the TRP when they collect their Portuguese Identity Cards. These Identity Cards would give the holder the right of free medical care and the right of free schooling. Their presence appears also required to open a Bank Account in Portugal. It seems that there is a branch of the Banco Santo Spirito in Hong Kong though.
申请人和家人需亲自赴葡萄牙领取葡萄牙身份证。该身份证使持有者享有免费医疗和免费入学的权利。Banco Santo Spirito银行在香港有分行,申请人和其家人可通过该分行亲自开设银行账户。
By the new policy requirements, the residency requirements have been reduced dramatically, In fact in the first year the minimum stay is seven (7) days, in the second and third year together the minimum residency requirement is fourteen (14) days and in the fourth and fifth year together the residency requirement is also fourteen (14) days.
然而,根据最新公告,居留要求明显降低。现在只需要申请人第一年居住至少7天,第二年和第三年总共居住至少14天,第四年和第五年总共居住至少14天。
The TRP holder can apply to extend his residency benefits to members of his family and these include the spouse, children under 18, children over 18 studying in an educational establishment in Portugal and direct parent of either marriage partner if living with them as dependents and also has been extended to brothers and sisters.
临时居留持有者可为家人申请福利,其中包括和申请人一起生活的配偶,18岁以下的在葡萄牙上学的子女和申请人夫妻双方的父母及兄弟姐妹。
The duration of the TRP process is estimated at between 4 to 6 weeks maximum. Renewal is on the first, third and fifth years..

The TRP holder and eventually the PR holder is entitled to work in Portugal
临时居留许可持有者和最终的永久居留持有者有权在葡萄牙工作。
After five years the TRP holder can either renew his TRP for a further 5 years or apply for a PR. After the sixth year he can apply for citizenship.
五年之后,TRP持有者可继续延续五年临居,或申请永居。六年之后,可申请入籍。
